Server assaulted, Defendant charged

AURORA - While on duty serving legal documents in Aurora, Colorado for Epiffany, Inc. A process server; Curtis Whited, was assaulted by defendant in a matter of domestic violence between the defendant and the subpoenaed victim, whom he was serving.

On 4-19-2009, at approximately 2135 hours, I was dispatched to 25322 E. Indore Dr., City of Aurora, County of Arapahoe, State of Colorado on report of a hot civil dispute. Upon arrival, I contacted the RP-Curtis Whited DOB. xxxxxx, who advised me of the following:

That on this date, while working as a process server for Epiffany, Inc. He was attempting to serve Reekae Mathew DOB xxxxxx, with an Aurora Municipal court Subpoena for Aurora Police case# 09-11525.

That he knocked on the front door of 25322 E. Indore Dr. for approximately five minutes without a response from inside.

That after approximately five minutes, a male, later identified as Paul Getz DOB xxxxxx, opened the front door.

That Getz was holding a pitcher of water in his hand, which Getz then threw the water on him, while he was on the front porch.

That Getz then told him "Get off my property, make my day law Motherxxxxx. I will shoot you, then drag you in the house".

That he (viz. Whited) immediately got off the porch and called 911 from his cell phone.

I then observed Curtis to be wet with what appeared to be water from his shirt down onto his pants.

Myself, Ofc. Mocaer and Ofc. Nelson then went to 25322 E. Indore Dr. in attempt to contact Getz and Mathews. After approximately five to seven minutes of knocking on the front door, Mathews opened the door and stepped outside the residence. I then advised Curtis to come to the front door so he could serve Mathews with the court issued subpoena.

While she was outside, I advised Mathews that I wanted to speak to Getz. Mathews advised that she did not know where Getz was at that time. Mathews allowed us to enter the residence to look for Getz.

Ofc. Nelson and I checked the entire residence for Getz, without being able to locate him. Prior to leaving, and while in the main living room of the house, Ofc. Nelson yelled for Paul to make himself known. Ofc. Nelson advised Getz that we would apply for an arrest warrant for him if he did not come down and give us his side of the story. While Ofc. Nelson was advising Getz of the possibility of a warrant being issued, I heard a male laughing from inside the house. Mathews advised us that the only other male inside the house besides Getz, was and elderly male that was sleeping upstairs and is hard of hearing. Mathews advised that the elderly male would not have heard Ofc. Nelson yelling for Paul Getz.

While we were searching the residence, I advised Mathews of what was said between Getz and Whited. Mathews first stated that she did not witness the altercation. Mathews then changed her story, saying that she heard Getz say something about the make my day law and shooting someone.

Based on the information provided by Whited and my inability to locate Getz, I will apply for an arrest warrant for 94-36 Assault, 94-37 Battery and 94-42(A)(2) Harassment.

This concludes my involvement in the investigation.
